Illinois consumer protection

Illinois has its own gift card statute, and it is more protective than most states. Under the Consumer Fraud and Deceptive Business Practices Act at 815 ILCS 505/2SS, a gift certificate sold in Illinois on or after 1 January 2008 may not carry an expiration date earlier than five years from issuance, and may not carry a post-purchase fee — no dormancy charges, no monthly deductions. Non-compliance can attract civil penalties of up to $50,000 per infraction.

Two limitations are worth knowing. The Illinois protection applies to single-merchant store cards; cards usable with multiple sellers — general-purpose prepaid Visa or Mastercard products — fall outside the state definition, though the federal CARD Act still imposes a five-year minimum on those. And prepaid telecommunications and technology cards are excluded from the Illinois definition entirely.

Target gift cards do not expire and carry no fees, so the Illinois floor is not a live issue for this brand. It becomes relevant when you are considering smaller or regional merchants, where dormancy fees have historically been more common — and it is a rule worth knowing, because a card sold in Illinois that charges a monthly deduction is operating unlawfully.
